In the event a service year is to only contain 1 checkup per year, the pricing will be based on the additional system price for each system covered.
Tankless water heaters are considered an additional system and will be treated as such.
Service Agreement Definitions
Bronze—Energy Savings Agreement
What's Included?
This plan is the basic of the three options and includes 1 heating visit and 1 cooling visit. A 15% discount** is applied to any service repairs that would be made on any visit during the Agreement time. In the event of a breakdown service visit, it is to be within 48 hours of call-in. All filters are an additional charge or to be provided by the customer.
Pricing
The pricing for this plan is broken down by the number of systems in the home. The first system is $258 if paid yearly or can be billed monthly at $22 per month*. For any Agreement covering more than one system, an additional charge of $155 per year is added for each additional system. If monthly billing, $13 per month* for each additional system is added.
Silver—Energy Savings Agreement
What's Included?
This plan is in the middle of the three options and carries all the same benefits as the Bronze Agreement with the exception of filters*** are included and a 4-month supply left with the customer during each visit 3 times per year. Service guarantee reduced to 24 hours from call-in time. Additionally, the service trip/diagnostic fee for any service visits is waived during the Agreement period.
Pricing
The pricing for this plan is broken down by the number of systems in the home. The first system is $488 if paid yearly or can be billed monthly at $42 per month*. For any Agreement covering more than one system, an additional charge of $293 per year is added for each additional system. If monthly billing, $26 per month* for each additional system is added.
Gold—Energy Savings Agreement
What's Included?
This plan is the best of the three options with all of the benefits of both Bronze and Silver plans. In addition, the service guarantee is further reduced to 12 hours from the time of call-in and 4 visits per year.
TechMasters LLC will cover the total cost of up to 3 basic non-major component repairs for each system under the Agreement. Does not cover pre-existing problems or failures. In the event a system replacement is needed, an additional 5% discount**** will be provided to replace any system under this plan during the Agreement period.
Pricing
The pricing for this plan is broken down by the number of systems in the home. The first system is $770 if paid yearly or can be billed monthly at $67 per month*. For any Agreement covering more than one system, an additional charge of $462 per year is added for each additional system. If monthly billing, $41 per month* for each additional system is added. Rental of the remote sensors is included in the price, and in the event Agreement no longer active, 'Customer' allows
TechMasters LLC to remove remote monitor sensors within 30 days of cancelation of Agreement or 'Customer' to purchase said sensors for the current sale price.
Tune-Up Procedures
The tune-up procedures are not limited to or all-inclusive of the actual procedures taken during a maintenance visit. Each system is unique in type and the way it may function for your home and/or business. Each Tune-Up maintenance visit invoice will be accompanied by a system checklist stating the operation and condition of the system at the time of the visit. Live remote system monitoring does not eliminate the need for a cooling/heating maintenance visit but does allow TechMasters LLC to know of potential failures before they fail, allowing for quicker repairs and less downtime of the system.
*In the event a monthly service plan is chosen, a service checkup will only be performed after 6 payments are made.

Tune-Up Procedures
The Agreement
This Service Agreement is being made between TechMasters LLC and 'Customer' for the address listed in this form. 'Customer' and TechMasters, LLC may also be referred to as “Party” or together as the “Parties”. This Agreement will become effective on the Start Date listed herein.
1. Services
We agree to perform the services (“Services”) listed for the selected plan. The Parties acknowledge that their obligations pursuant to this Agreement serve as good and valuable consideration for this Agreement.
2. Compensation
They say nothing good in life is free, and Our work is no exception.
Payments will be made in the terms listed herein.
3. Expenses
We will be reimbursed by You for any reasonable and necessary expenses (not including the listed benefits of the selected plan) incurred in providing the Services. You must pre-approve all expenses.
4. Payment
Invoiced amounts must be paid by You by the due date listed on the invoice. As much as We like cash money, payments are preferred to be made by [credit card]/[check]. Check payments must be made to:

5. Term
The term of this Agreement is 12 months from the Effective Start Date for yearly billing, unless terminated earlier for other reasons available in this Agreement. Monthly Agreements are renewed on a monthly basis and shall continue for 12 months from the Effective Start Date.
6. Termination
a) If either Party wants to terminate the Agreement before the termination date, they must provide the other Party a 30 day written notice. If You terminate the Agreement before the Services have been completed, You will be liable to Us for a pro rata share of the total cost of the Services as outlined herein.
b) This Agreement will automatically renew when both Parties have performed all of their obligations under the Agreement and all payments have been received at the end of the Agreement period.
7. Relationship of the Parties
a) No Exclusivity. The Parties understand that this Agreement is not an exclusive arrangement (i.e., the Parties aren’t “going steady”). The Parties agree that they are free to enter into other similar Agreements with other Parties.
8. Waiver
Neither Party can waive any provision of this Agreement, or any rights or obligations under this Agreement, unless agreed to in writing by the Parties. If any provision, right, or obligation is waived, it’s only waived to the extent agreed to in writing.
9. Amendments
This Agreement may be modified as needed. To make a modification, the Parties have to agree to the modification in writing (an "Amendment"). The terms of this Agreement will apply to any Amendment the Parties make.
10. Assignment
The Parties may not assign the responsibilities that they have under this Agreement to anyone else unless both Parties agree to the assignment in writing.
11. Dispute Resolution
a)
Negotiation. We want to work this out. In the event of a dispute, the Parties agree to work towards a resolution through good faith negotiation.
b) Mediation/Arbitration. If talking it over doesn’t go well, either Party may initiate mediation or binding arbitration in the State of VA.
c) Litigation and Choice of Law. We hate fighting, but if litigation is necessary, this Agreement will be interpreted based on the laws of the State of VA, regardless of any conflict of law issues that may arise. The Parties agree the dispute will be resolved at a court of competent jurisdiction in the State of VA.
d)
Attorney’s Fees. The prevailing Party, also known as the winner, will be able to recover its attorney’s fees and other reasonable costs for a dispute resolved by binding arbitration or litigation.
12. Entire Agreement
This Agreement puts the Parties entire understanding of the Services to be performed and anything else the Parties have agreed to in black and white (literally). This Agreement supersedes any other written or verbal communications between the Parties.
13. Severability
If any section of this Agreement is found to be invalid, illegal, or unenforceable, the rest of the Agreement will still stand.
14. Notices
All notices under this Agreement must be sent by email with read receipt, or by certified or registered snail mail with return receipt requested.
